“I’m still here with you” Project License Policy

This license policy (“Policy”) covers all NFT artworks (“NFT Artworks”) , digital paintings with NFT (Non-Fungible Token) technology, and the elements thereof (“Elements”), including but not limited to the themes and parts of the NFT Artworks, which are provided or created in “I’m still here with you” project (“Project”). By using the NFT Artworks in the Project, the users of the NFT Artworks (“Users”) shall be deemed to have accepted this Policy.

1. Purpose of this Policy

(1) The purpose of the Project is to contribute to the social use of NFT technology through the NFT Artworks. For the purpose of the Project, this Policy provides terms and conditions of the use of the NFT artworks.

2. Rights of NFT Artworks, etc.

The project team of this Project ("Project Team”) reserves all rights of the NFT Artworks and the Elements, including but not limited to copyrights.

(2) For the avoidance of doubt, save for use as expressly permitted under this Policy, all rights of the NFT Artworks, including but not limited to copyrights, belong to the Project Team. The Users shall not assert any moral rights of authors or attempt to otherwise acquire or derive intellectual property rights in or to the NFT Artworks.

(3) The Users shall use warrant that all the activities by the Users in the Project will not infringe upon any copyright, patent or other intellectual property interest of any third party. The Users will indemnify and hold the Project Team harmless from and against all such infringement claims, losses, suits and damages including, but not limited to, attorney’s fees and costs, and shall immediately correct the activities so as not to be infringing.

3. Terms and Conditions of the Use of the NFT Artworks

(1) The Users shall be allowed the following uses of the NFT Artworks* only for noncommercial purpose; provided, however, that the Users who purchase the ownership of the NFT shall be allowed the uses for commercial purposes until the cumulative amount of sales from the uses of the NFT Artworks reaches one hundred thousand US dollars for each of the NFT Artworks.

a. transmission to the public via the internet

b. making and display the physical artworks of the NFT Artworks

* Whether the uses for commercial purpose or not, the Users shall not be allowed to alter, cut or modify the NFT Artworks or/and the Elements and to use only the Elements.

(2) The Users may use the NFT Artworks without copyright notice (credit).

(3) The Users shall be prohibited from the following uses of the NFT Artworks. The Project Team will take remedies against the violator, including but not limited to the prohibition of the use of the NFT Artworks and revocation of the license.

a. uses outside the scope of this Policy

b. uses for the purpose, in the situation or in the context found to be inappropriate by the Project Team (including but not limited to slander, obscene expressions, crime and any anti-social activities)

4. Revision of the Policy

The Project Team may revise this Policy. If this Policy is revised, it will be announced on the website in advance.

5. Governing Law and Jurisdiction

(1) This Policy shall be governed by and construed in accordance with the laws of the Republic of Singapore without reference to principles of conflict of laws.

(2) Any and all disputes arising out of or in connection with this Policy shall submit to the exclusive agreed jurisdiction of the Republic of Singapore.
